What Are Contingent Attorney's Fees?
It is hard for me to say what exactly the attorney's fees will be for particular personal injury cases
. But I can tell you that personal injury attorneys usually charge on a contingency fee basis. That means that the attorney's fees are a percentage of any settlement that you win.
To say it again, because this is that important for accident victims needing help to pay medical bills, the amount that the personal injury attorney will charge is contingent on the successful settlement of the case. This is why personal injury lawyers will advertise that you don't have to pay any fees unless you win. In the end, the attorney fee that you pay is included as a percentage of your settlement if you win. If you don't win your case and receive a settlement, then your injury lawyer is not going to charge you an attorney's fee.
A contingency fee is different than what a lot of other lawyers in other areas of the law do, which is to charge by the hour or offer a flat fee. Now, the percentage of the settlement that your lawyer will collect depends on the agreement you and your personal injury attorney make. A lot of times it depends on if the case is settled out of court or if it goes to trial. But, there are a whole lot of other factors your injury lawyer might take into account. There are a few rules that great injury attorneys follow, however, like requiring that the fee be reasonable, that the contingent fee be agreed upon in writing and signed by the client, and that upon completion of the case the attorney must account for why and who gets different amounts of money.
So I should find the cheapest injury attorney out there, right? An attorney that accepts the cheapest rate? Absolutely not! Price shouldn't be the sole reason you pick a personal injury attorney. After you have been hurt in a car accident, for example, and you need help to pay your medical billsthe cheapest attorney might be the worst decision. Why? While a cheap lawyer will have low priced fees, you could end up without enough to get you all the help you need for medical bills and be stuck in debt.
When looking for an injury attorney to handle your case always make sure you know for sure, and in writing, how the fee will be calculated, if the fee changes depending on how far along in the court process your case goes, and what happens if you lose. That way you know exactly what you are hiring someone for, and you can get the best quality attorney.
