What Is A Sublease Agreement?

A contract used by a tenant, to rent a portion or whole of his rented property, to a third party for the remainder of the lease term is called a sublease agreement. This lease makes the original lessee, both, a tenant and a land lord. But a prior permission from the landlord is necessary for the original tenant, before going ahead with letting it to another tenant. This assent is always required in writing.

1. Commercial

2. Residential

It should contain the details of the sub-lessor. These details include his personal identification details, mention of his primary contact information, and information of his profession as well.

It must have the details of the sub tenant, which include his contact details, information of his previously resided address, his professional details, and the rent agreement for a fixed period of time. The contact details, in this case are of a great importance, as, in case of any illegal happening on the sub tenant's behalf, can be acted upon legally.

The term of the sub lease and a fixed monthly rent to be paid by the sub tenant are vital in this kind of a lease.

The rent should be paid by the sub tenant to the tenant, not later than the due date.

There are a certain charges, like garbage charge, sewer charge, water charge, electricity charge etc. which are mentioned in the master lease, i.e. the lease from the land owner to the tenant. These charges are titled to the sub tenant as well by the original tenant. Therefore, the sub tenant is entitled to pay and procure for any utilities or services, which might not be present in the master lease.

It is always advisable to get the lease signed by at least two witnesses so as to avoid any kind of complications later.

The terms of the agreement should always be clearly stated in a sublease document, so as to facilitate the sub lessor in claiming back the property once the original lease period is over.
