What To Do If You Are Pulled Over On Suspicion Of Dui
This article is prefaced with the thought that driving when under the influence of alcohol or drugs is dangerous and immoral
. So much pain and heartache has come from the crime that endorsing it is perhaps a crime in itself. That said, some people like to enjoy a social drink once in a while and will not consume enough alcohol to impair themselves or go above the legal blood-alcohol limit of 0.08% If, in this condition, you are pulled over by the police, what should you do?
Before addressing that issue, let's look at what you might have done to avoid being pulled over in the first place. Police don't have scanners that scan you blood-alcohol level from a distance as you pass; you have to draw a red flag in order to be targeted. If you are driving home late on the weekend, then you are already in the red flag category and you might be pulled over at random just because of the hour.
Beyond that, make sure your car is in good working order and that the registration is current. If you have the choice, drive something unassuming. Also, make sure you drive conservatively, allowing plenty of space between you and the vehicles around you. If you are still pulled over, you should know your rights.
Here are a few rules for you to follow:
1.Be ready to hand over your license, registration, and insurance without fuss or hassle.
2.Stay calm. Becoming flustered or emotional can be construed as a sign of being under the influence of alcohol. Keep your cool, even if you are nervous.
3.Be polite. When the officer approaches the car he will likely ask you if you know why you were pulled over. It is best to respond with a "No, sir" and let him tell you. Police pull people over all the time for many different reasons.
4.Don't admit to anything. There is a fine line here. You should not lie to an officer, but you also have the right to remain silent. This is not your Miranda right since you have not yet been arrested, but a healthy protection of silence can be your friend in this situation.
5.Remember that you are being recorded and that those recordings can be used by both prosecution and defense attorneys.
6.Finally, you have the choice whether to take any field sobriety tests, including a breathalyzer. You can politely refuse and be cited or perhaps arrested, but the tradeoff may be in your best interests since breathalyzers can be inaccurate and the longer you postpone a test the longer your body has to reduce the level in your blood.
Lastly, since you can be arrested for DUI in Ohio, Florida, or any state, you should be familiar with the specific laws of that state. Consult an attorney if you have questions, concerns, or have been arrested and need representation. The best defense, of course, is to drink responsibly and have a designated driver or a taxi to get you home.
