The same solicitor one might use to draw up a will or lease agreement isn't necessarily appropriate for handling a divorce. If possible, find a specialist with training in family law. Solicitors with courtroom experience should be sought out if either party is convinced the divorce will be contested and could go to trial. Where children are involved, or if custody arrangements can't be agreed upon without outside mediation, a quality solicitor will stress the importance of prioritizing the children's needs above all else. Those willing to pursue preposterous child support demands or custody arrangements should be avoided.

Due to the intimate nature of divorces, and the personal details that might have to be shared by the client, finding someone trustworthy who can behave professionally is a necessity. Personality is also a factor. If the client's wish is to keep things non-adversarial, choosing a solicitor who is antagonistic or combative isn't going to foster a good working relationship. A client should always feel as though steps in the divorce process are being adequately explained to them. Cost is another factor to consider. If the divorce is amicable, and nothing is being contested by either party, try to find someone willing to fill out and file the necessary papers for a flat fee. Otherwise, most solicitors charge by the hour. The initial phone call is a good time to inquire about prices. Some solicitors charge a retainer, or an up-front payment, to secure their services. If the retainer seems too high, it's safe to assume you can't afford that solicitor. Determining the total cost can be difficult, however, as it depends on both the amount of assets, making the necessary custody arrangements, and the degree of conflict involved. Don't be afraid to get several estimates by phone until a suitable one is found.


Even though divorce can be a confusing time, making the right choice when it comes to a solicitor is a crucial decision. Do the necessary research, ask lots of questions, and make sure you understand the process before you hire representation.
