Who Are Phonepay Plus And What Do They Do?

PhonepayPlus is a regulatory body that was previously known as ICSTIS

. It regulates all premium rate phone services in the United Kingdom. Premium rate services are those that customers can buy by charging the cost of the service to their phone bills.

PhonepayPlus uses a Code of Practice to issue regulations. The Code of Practice is approved by the Ofcom. It sets out all rules and practices that providers of phone-paid services have to necessarily comply. It also requires accurate pricing information with no ambiguity, honest advertising and service content that does not mislead as well as appropriate and targeted promotions.

The regulatory body also investigates any complaints raised by customers about the phone paid services that they have received from a service provider. If PhonepayPlus decides that any of the rules that they have set forward by them have been broken by the service provider, they can fine the company, bar access to the services that it provides and even ban the company from running other or similar services under a different company name. All investigations and adjudications are completely free to customers. They are also fully independent.

When PhonepayPlus rules on a breach of code, the company that has been found responsible must immediately amend the promotional materials and its services so that it complies with the Code. The company at fault are also required to cover the cost of the investigation in most cases.

PhonepayPlus also has the power to impose sanctions as follows: o Make formal reprimands o Make companies come to the regulator for prior approval o Order companies to pay full refunds to complainants o Impose fines as they deem fit o Bar access to services o Ban named persons from operating services under another company name

Under the Communications Act 2003, Ofcom has responsibility for the regulating the premium rate services. PhonepayPlus was confirmed as the agency which will act to carry out the day-to-day regulation of the premium rate service market on Ofcom's behalf. This confirmation was made in December 2007.

PhonepayPlus is a non-profit making body. It has ten part-time Board members who are supported by a full time executive. They use the Code of Practice to regulate content and service promotions. They also provide advice and guidance to service providers who are both existing as well as new.

PhonepayPlus focuses on pre-empting and preventing problems. That is the key to effective customer protection on a long term basis.
