If you have not yet created a will you may have no say over what happens to your assets and belongings after your death
. This can create a lot of problems for your loved ones after you die. It is obviously important to make a will in order to stop this. It is also particularly important that you make a will if you have either of the following; are married or in a civil partnership, a long term partner, children, a particular wish of how your assets be divided after your death.
Creating a will allows you to have a permanent written record of how your estate be managed after your death and gives both you and your family reassurance that everything is in order.
It is a popular belief that if you are married or in a civil partnership then your partner will automatically receive everything should you die. However, this is not strictly true if you do not have a will in place. The law then decides on how your assets are divided up, this is done to be as fair as possible but the outcome may not be to yours or your partner's wishes. A good example of this is when a wife or children outlive a father who did not leave a will. The law will then be left to decide who your assets are divided.
It is important to note also that the law makes no provisions for your partner if you are not married or in a civil partnership no matter how long you have been together or lived together for.
It is of course acceptable to create your own will however this is not advisable. Seeking legal advice is a must-do with something as important as your will. Seeking the advice of a professional will also mean that you are certain that the will complies with any legal requirements that are necessary.
