Why You Should Hire a Former Prosecutor if You Are Seeking a Criminal Defense Lawyer


You have been charged with a crime. Now what? Your court appointed attorney is simply not doing the job and you need to hire an attorney. Who should you hire? The first thing you should do is find an attorney who specializes in criminal defense and not a jack of all trades. After you have done that, it is critical to hire a criminal defense lawyer who was a former prosecutor in the jurisdiction you are being charged in. There are some simple and powerful reasons for this.

EXPERIENCE

If your attorney was never a prosecutor, he has never seen the process of criminal prosecution up close. He has never walked into a supervisor's office to discuss a case and he has never been exposed to the inner workings of the District Attorney'e Office. For example, the NYPD has a unique relationship with the District Attorney's Office. A former prosecutor will know how to exploit that relationship to the benefit of the client. Not all police agencies are cooperative with the DA and some are downright hostile. A former prosecutor will have a deep understanding of the DA policy and know when exceptions have been made and when the best deals have been cut.


PERSONNEL


An attorney who has been a former prosecutor will know the judges and prosecutors in the jurisdiction you are in. He has also benefited from being trained by people who have a wealth of experience with all of the judges in the court and the higher ups in the DA's office. They have had many occasions to socialize with prosecutors and judges. The former prosecutor will be familiar with the court clerks and court officers and is familiar with where all of the courtrooms are, which in New York City is very important. Because of this familiarity with every part of the criminal justice system, the former prosecutor can more ably give you a realistic assessment of your case.

INTANGIBLES

As a former prosecutor I can tell you things about the criminal justice system that only people who have held my position would know. How does the grand jury actually work? How fast can a case be put in the grand jury?When is the best time to call a prosecutor to get the best deal? How will a particular prosecutor handle a case? These are all things that can be learned ONLY be being in the belly of the beast. After five years as a DA, I have come to learn all of the wrinkles in the system and how to most effectively represent my clients. This notion of experience in nothing new. Former senators are hired as lobbyists, former FBI agents are hired as security experts, former athletes become commentators on television. In all of these examples, the experience that these people bring to their new positions cannot be learned from a book or a classroom. You must live it.

When deciding on whom to hire as your criminal defense attorney, retain the former prosecutors in your jurisdiction. Attorneys who have not had this experience are simply outsiders looking in.
