Work Accident Claim

A work accident claim is a personal claim made by an employee who develops illness

and or get injured in the workplace or while doing work in another setting. It is important that employers will make sure that the workplace is safe for employees to prevent any accident to happen or illness that is caused by negligence of the company. Any employee who gets hurt and sick due to the carelessness of the employer can file for a workplace accident claim under the no win no fee system. In filing for such claim, the employee must be able to present an evidence-based documentation on the cause of the accident. This further strengthens the grounds against the employer as negligence and contravention of health and safety rules are against the Health and Safety at Work Act of 1974.

Employers in general are expected to comply with the said act and practice safety working environment; however, not everyone is compliant to this that results to subjecting the employees into a higher risk of getting into accident and or getting ill. Some construction site injuries are mainly caused by non-wearing of safety gears and safety equipment like hard hat, harness, safety glasses or goggles, high visibility vests, and work sturdy gloves. Although this can be the worker's mistake, the employers on the other hand holds more liability as it is their duties to provide all required and necessary equipment as well as to institutionalize a health and safety guidelines in the workplace.

Work accident claims may also result from working in a hazardous environment involving exposure to toxic and dangerous substances. An example to this is the construction industry where workers are constantly exposed to chemicals and physical trauma. Construction workers are commonly experiencing back and arm problems due to rigid physical activities; and illnesses such as asbestosis and lung cancer. It is not surprising that construction workers may develop disabling and life threatening diseases as this type of industry is engaged with such risks.

Exposure to chemicals such as the asbestos can cause Mesothelioma and Asbestosis to anyone. Asbestos is a construction material that has been in existence for decades already. In fact, this material is a major component of most construction materials from flooring to roofing. Tiny strands of asbestos

can be carried on outside the construction site by means of clothing, hair and skin. When a construction worker makes physical contact with other people, he also put others at a high risk of developing diseases caused by asbestos.

There are other more reason for a work accident claim. While employers are highly responsible for the employees' welfare at work, it is still best to avoid accidents. Both employers and employees are advised to practice safety procedures at all times.
