A Section 21 Notice to Quit, operates under the section 21 of the Housing Act 1988, it is the notice a landlord provides to his tenant to regain possession of a property at the end of an Assured Shorthold Tenancy [AST].
The landlord does not need to give a reason for gaining possession of the property just as long as they give the proper notice.
In order to be able to give the tenants this notice the landlord must follow a set of procedures and rules. There are two types to the section 21 notice and which one you follow will depend on if the fixed term has come to an end or if the deadline is still in the future. You can still use the section 21 notice if the fixed term period has changed to a periodic tenancy.
If the tenancy period was for a fixed term then the landlord cannot take possession of the property until the last day of that agreed upon the fixed term.
Section 21 Fixed Notice Seeking Possession
The tenancy agreement hasn't yet expired.
In most cases two months should be given.
The two months notice must not end before the expiry date of the tenancy agreement.
Section 21 Periodic Notice Seeking Possession
The tenancy has already expired and has not been renewed, thus making it a periodic.
The notice can be issued any day after the expiry of Assured Shorthold Tenancy.
The tenant should be given at least two full periodic months notice.
