Not only is much of central Delhi part of Lutyens zone, it is subject to several restrictions and even in this case the government had raised security and other issues. It has been argued that lack of high rises have locked up land up use in the city and if the plans to use the large space for residential work out , it would break fresh ground.
According to the firm, they are the owners of the property at Sardar Patel Marg since 1942 and in the year 1970, decided to seek permission from the UD ministry for constructing society flats, prompting a lengthy legal tussle between the two over conversion charges. EKSPL had argued in HC that it ought to be allowed to construct flats on its property as the latest Delhi Master plan allows that area to be used for residential purposes . Urging HC to direct the government to permit conversion from dairy farm to residential, the petitioners maintained they had deposited the conversion charge in 2008.
The government pointed out that the property in question is located in the high security zone housing the President of India and therefore any rising of an apartment complex was likely to pose security concerns. It also argued that once the permission is granted, a request for redevelopment of property is bound to follow.
