subject: What is the best way to not get sued? [print this page] Send the $100Send the $100. They note everything in your account, so any attempt to pay them off is better than no attempt at all. You can really try to work it out with them to have a payment plan. They just want their money. Just hope you get one of the nice operators and hope for the best. Good luck. Debt sucks!
If you really feel like you're sinking with debt, call a debt consolidator. I don't have any off the top of my head, but an ex and a couple of friends have gone through them, saving their butts from creditors. It's great if you have terrible credit because they can help you rebuild credit also
They will not sue you as long as you are sending them money. DO NOT give them your bank account number to draft out the money. Send them a money order or cashier's check instead. They will clean out your account if you give them the info! It is illegal, but they do it all the time.
I promise, they will not sue as long as you are sending them money.
You always send them what they can to show you are making a good faith effort. It doesn't hurt to talk to them as well to try to work out a schedule. If you don't get the right answer, then don't waste your time with that person and ask to talk to their supervisor and work your way up the ladder. They would rather get money than sue you.
Call them and tell them you can send 100.00 now and when you will be able to make the next payment. Technically they can sue you. However understand they are likely saying this to 'encourage' you to pay. It would cost them more to sue you then to write it off. Paying them SOMETHING now increases your chance of not getting sued.
Also understand that getting sued doesn't mean much. You'll get a judgement against you to pay but they still can't force you to.
It's admirable that you are trying to do the right thing. A lot of creditors are sleazy-don't let them faze you.
You should really just stick to one credit card. As of now, you should write to the credit card companies telling them you want to cancell your credit card. Then, if possible, send them your remaining balance and end it. Just one card is all you need. My mother had the same problem and cancelled all her cards but her bank card. You are better off.
Try calling them first. If you tell them you are sending something and you send it, they will usually back off somewhat. Give them a call and see if they will work with you. They know that if they sue you and you merely don't have the money, they won't get it anyway. So they'll likely work with you. If you do nothing, however, they most likely WILL sue anyway, and if you have a job, you could get your wages taken. It sucks. Good luck!
