subject: Canada Name Search - Tips On Ordering A Federal Name Search Report [print this page]

A Federal Nuans Name Search is required when incorporating a federal company in Canada. These searches are sometimes called a Canada Business Name Search or a Canada Name Search.

The federal government will take great steps to ensure that when incorporating a federal corporation there will be more protection for the name across Canada. Industry Canada will ensure that a proposed name for a corporation does not conflict with any other company name already registered in Canada.

Your name will be looked over by the federal government very carefully. The government has a policy called Name Granting Guidelines which has a complete breakdown of how Industry Canada picks a name. Unless you have training you would not be able to weed out the names on a search that would be a problem for getting your name accepted.

Having a search house perform a preliminary name search first will save you time. Industry Canada will not allow any name to be registered which is anywhere close to any name already on file and will even reject names that sound like other registered names. Therefore it is a good idea to have a registered search house do the preliminary name search in advance.

An experienced search house that has been registered will be able to find many of the conflicts. Ordering a federal name search without doing a preliminary name search in advance will mean that if your proposed name is not accepted by Industry Canada you will be required to provide a new federal nuans report for another possible name. This can become expensive since this could happen many times when trying to get a name approved.

The federal government as well will provide you with a name clearance which is called a Federal Name Decision which can be obtained in advance of filing your articles and save wasted time. However, a Federal Name Decision cannot be obtained without first providing a Canada Name Search. They will not look at a proposed company name without a full Federal Nuans name search report being provided to them. Hence, the reason for the preliminary name search.

The federal government is extremely careful when it scrutinizes a federal nuans name search report and there really is no guarantee your name will be accepted but an experienced search house can help reduce the likelihood of a rejection.
