Even if one spouse files bankruptcy during a divorce it does not exclude them from having to pay child support. Student loans do not get cleared when a person files for bankruptcy. Money problems are known as one of the main causes of why people get divorces. The chapters of bankruptcy are determined by the combined income if filed jointly or just one individual income if filed separately. Many couples choose to file for divorce and bankruptcy together because they want to make a fresh start in life. Both of these procedures are very stressful. Bankruptcy and divorce court could take longer to process because it involves a more than just a usual divorce. One of the negative sides to filing for bankruptcy is that both spouses are responsible for all the debt collected during the marriage even if it is not their own debt.
