The divorce process is used to be a very long and arduous journey for both parties. Before the 1970's, no-fault-divorce was nothing but a distant dream. Married couples must come up with reasonable grounds for divorce before the court can actually entertain them. Divorce may result from 2 occurrences. First: both parties no longer feel the urge to live together in marriage; second: one party (either the husband or wife) do not want the other anymore.

If you and your spouse wanted to have a divorce just because you do not want to live together any longer, that cannot be a basis to grant you one. A divorce without a fault is never allowed in the old times thus prompting lawyers to come up with false stories in order to approve their clients' request. Lawyers before can make legal fictions to show the court that someone in the marriage is at fault; they can hire false mistress and stage a "drama" to make their stories more believable. Clients, their "hired mistress", and their lawyers can arrange for a small play where real photos are taken in the most plausible places. They may even write a script to make it look like it was tapped from the telephone.

If you are in the second situation and cannot find any good justification of your request, the court cannot grant you a divorce. You must be able to provide enough evidence that your spouse has committed a crime against the law such as adultery or marital cruelty of any type. Getting enough proof of your spouse's cruelty or infidelity is never easy. In order to provide what the trial court needs, you might have to hire a detective to help you out in getting photographs or to tap relevant conversations. In addition, you have to constantly be on guard looking for ways on how to expose your spouse. That is never too simple and can be quite offensive to the other person especially if he or she has not done so much damage on you.

These situations have become so popular that some group of people which is mostly led by feminist lawyers started to pursue no-fault divorce. The American justice system has become blind with the constant perjury of lawyers and citizens who only wanted to obtain a divorce. The movement was accepted by the general public and now, couples who do not want o live together can separate in good terms with the no-fault divorce.
