This year is undoubtedly going to be a very crucial year regarding US immigration. There are going to be a lot of reforms with regards to legislations like the Dream Act and Senators Grassley, Durbin's H1B visa, L1 Visa. This has been debated and we can say for sure that this year is surely going to be a year of ups and downs for US immigration.

Things are not looking all that good as it was in the beginning of the year. Even at that time, there was some hope that the Healthcare Reform Bill would somehow help things progress. Even at that time there was hope that the bill would pass the Senate in Congress and the House without further delay.

President Obama would have signed the bill into law. Under such circumstances, thanks to the divisive nature of the Healthcare debate, there are only two possibilities. People who intend to take their spouses along with them need to apply for a separate visa. The first thing to do is to file the immigrant petition. The form I-130 needs to be filed for this. Once you receive the receipt of approval, the next step would be to visit the Consulate of United States and obtain the physical immigrant visa. The third step is the filing of EAD (Employment Authorisation Card). The next step is filing of your social security number at the office of the Social Security.

The next best option would be to use the non-immigrant visa (commonly referred to as a K3 visa). This is like a temporary visa wherein your spouse can accompany you and stay for a short period. While applying for the K3 visa, certain things need to be taken into consideration. The filing of the K3 visa application needs to be done at the place where the marriage took place. Hence the place of issuance of the K3 visa needs to be as is mentioned earlier. Once the formalities are completed, your spouse can accompany you and stay with you till the paperwork and formalities related to the actual immigration visa are completed.

The visa can be filed at the nearest US consulate. If you have children below the age of twenty-one, then you need to apply for a K4 visa.

The next step is to apply for the EAD card, which enables you take up employment in the United States.
