Head shops are of mythical standing during the 1960's and 1970's because of the secrecy of its contents and stories believed to be about its unusual merchandise that entertained its customers.

Head shops are retail outlets that specialize in selling drug paraphernalia related to the use of recreational drugs and New Age herbs along with counterculture art, magazines, music, clothes and home decorations. Usually, they sell things that typically include bongs, sometimes call water pipes in other countries, roach clips, pipe screens, glass pipes, vaporizers, rolling papers and a lot more. The name head shop originated in San Francisco during 1966 from a store that sold counter-culture merchandise like comics, things for herbal smoking and legal buds and aromatic plants.

During the 60's and 70's hippies have grown into environmentally aware baby boomers and the popularity of head shops waned and then changed into amusing, conservation conscious establishments that is jam-packed with marvelous gifts and home items. They almost became non-existent until about the time when waterbeds came along; and then came the rise of the requirement to change the world's waste and dumping mindset into environmentalism and green movement.

These head shops do not provide products that are illegal or unlawful. They could never last eight hours during the first day of opening if they sold such items. They are in fact caustic in how they refer to the products being sold and are rigorous in who shops in it.

In the United States, the legality of head shops borders in a somewhat grey area mainly because of the materials they sell which are usable for both legal and illegal drugs. In some states, such paraphernalia are considered illegal. These head shops often argue that the products they sell are not among drug paraphernalia that are considered illegal as they are only intended to be used for herbal legal highs, herbal smokes, and other legal substances. During the 2000s, they reemerged regionally along with internet sell sites to service this health market due to the passage of state laws that allows for medical marijuana.

Most head shops bear signs stating that customer indications that the shop's products are being used for illegal drug activities will result in the suspension of all sales for that period, and the immediate prohibition of the particular customer's from ever entering the shop. Head shops usually use signs saying that the product being sold are "for herbal smoking purposes only" or "not to be used with illegal substances".

Nowadays, even online shops that sell only legal buds and herbal smokes control costumers by making them comply with strict disclaimers before being allowed to shop. Customers must agree to these disclaimers before they can even take a look at their products.
