subject: How Can You Trademark A Slogan? [print this page]

If you live in the United States and you would like to trademark your company's slogan then you should be aware that the trademarking process can vary from one jurisdiction to another. You can usually take care of the entire trademarking process on the Internet, although many of the trademark agencies will also accept your application in the mail.

In order to successfully trademark your slogan you will first have to find the organization in your area that is responsible for trademarking. You will be able to find it in either your local phone book, or you can do a search for it online.

After you've found the correct agency the easiest thing to do would be to go to their website in order to find out what you have to do in your specific jurisdiction. However you can also try to give them a phone call and get the information you need that way.

No matter where you live, one of the first things that you will have to do is to make sure that the slogan you would like to trademark has not been trademarked already. Most of the trademark agencies have a database that you can access online for free in order to find out this vital information. In order to find out whether the slogan has been trademarked use the exact name you want to trademark in the database search engine.

If you're not comfortable with this process you may find that your agency will allow you to conduct your search either on the phone or through the mail.

Although it usually isn't a requirement you should also consider doing an online search for different organizations or companies that might be using your slogan. Just type the slogan into the search box in your favorite search engine.

Then, if you find that someone is using your slogan, even if they haven't trademarked it yet, you should give some thought to choosing another slogan. Otherwise you might find yourself as the defendant in a lawsuit. Also, by having a totally unique trademark you will avoid any confusion in your customer's minds about your slogan and who it belongs to.

Only after you've done all of this can you actually fill out the application and submit it along with the proper fee. If you thought that all of the preliminary work was very time consuming, well, as they say, "you ain't seen nothing yet."
