How to be FTC Compliant
There is a lot of confusion as to what disclaimers & documentation is necessary for different sites. Here at AutoWebLaw Pro, Our philosophy is that it's better to have too much documentation than not enough.
So when in doubt put it on there.
All sites should have at a minimum, a Terms of Service and a Privacy Policy including a Children's Privacy Policy, an indemnity clause & an arbitration and mediation clause.
Many of these can be combined, but it's a good idea to keep your Terms of Service and Privacy Policies separate.
And if you are selling products to help people make money or produce specific results, it's important to include income results or product disclaimers depending on the circumstances of your site.
You also need to include an Affiliate Affidavit if you are selling products other than your own, telling your visitors of connection between you and the product owner...monetary or otherwise.
And last but certainly not least, you need to be VERY careful of the testimonials you use!
As of December 1st, 2009, the FTC is no longer accepting testimonials that the average person can not expect to achieve. AND...they want proof from studies that the expected results can be quantified.
This makes using anything but generic testimonials dangerous to use, unless you can afford to have a study done by an independent contractor, so that you can prove your results.
The old "Your results may vary", is no longer accepted.
There are many other types of legal documentation that may be required, depending on the type and purpose of your site. But rule of thumb tells us that the above mentioned documents are required on most sites.
