Each state has its own labor laws, which work in conjunction with the U.S. Department of Labor and the Fair Labor Standards Act (FLSA). New Jersey Labor Law protects and provides rights to New Jersey workers. Among other things, it establishes a New Jersey minimum wage and laws concerning overtime.
Overtime in New Jersey
Unless you are an exempt employee, any hours worked over 40 in a workweek (a standardized, 7-consecutive-day period) are considered overtime by Federal and New Jersey overtime law. Overtime hours are paid at 1.5 times your regular, "straight-time" hourly rate. If you are salaried, that is calculated by dividing your salary by 52 to get your weekly rate, then dividing that number by 40.
Certain types of employees are exempt from this overtime pay provision. If you are salaried and work in an executive, professional, or administrative capacity, you are not entitled to overtime pay. Those terms are more clearly defined on New Jersey's Wage and Hour Division website. Other exemptions exist for outside salespersons and service employees.
Minimum Wage in New Jersey
The New Jersey minimum wage is the same as the Federal minimum wage: $7.25 an hour. This covers tipped employees as well. If you make over $30 a month in tips, your employer may count them toward your minimum wage requirement, but any lack must be covered by the employer.
New Jersey minors are not guaranteed the minimum wage, unless they work in one of the following industries:
Retail
Food service
Cleaning and dyeing
Hotel and motel
Beauty culture or apparel
First processing of farm products
