subject: What to do when you are involved in an accident? [print this page]

What to do when you are involved in an accident?

If you are hurt in a car accident or a slip/trip and fall type of situation, you should

immediately seek medical attention. Especially with slip/trip and falls, people are often

embarrassed and simply want to leave the scene. There is often a shock factor that can

hide or mask an injury. Seek and obtain medical attention.

Once you have sought and obtained medical attention, talk to a lawyer. You may have

absolutely no case what so ever. You may have a difficult case. You may have an easy

case. But you will never know until you consult with a lawyer.

If you are injured beyond the first few days or weeks following an accident or incident,

you should continue seeking and obtaining medical attention. Sitting at home and

suffering in silence will not help you either medically or legally. If you continue to

work after an accident even though you are in pain, you should document the fact that

you are working in pain. This may involve advising your supervisor. It may involve

telling this to your doctor when you meet with him or her during your accident related

consultations. However, going to work and suffering in silence does not help you

medically or legally.

If you are involved in a car accident, a representative of one or more insurance

companies will likely contact you sooner rather than later. Please keep in mind that

insurance companies are not necessarily your friend. They are not your neighbor, let

alone a good one. And you are probably not in good hands with the insurance company

and/or the representative. Generally, your interests and the interests of the insurance

companies run in opposite directions.

Do not sign any documents until you have consulted a lawyer. Do not allow a statement

to be taken until you have consulted a lawyer. Do not allow the insurance company

to send someone to your house for any sort of assessment until you have consulted a

lawyer. This is simply the most cautious way to move forward following an accident.

There are some very nice people involved in the insurance industry, but like any other

industry, there are those that are less than considered about you and your well being.

You should know your rights. You should know what your are entitled to and what your

not entitled to and you should be confident that anything can be done for you is being

done for you.
