Big drop in Florida foreclosures, but it's only a brief reprieve

Although Florida's foreclosure filings continued to plummet in February, dropping about 65 percent compared with the same time last year it's not because the banks want to help you or it's some signal of economic recovery.

I continue to be quite concerned about those homeowners that are in default and sitting back doing nothing because they have not been served with a foreclosure suit. That being said I

can't impress upon everyone enough that this is nothing more than the calm before the storm. Once the lenders revamp their procedures and so-called "foreclosure mills" sort out their issues with orphaned cases, filings will spike again this year. Most of the issues are the continued fallout from the robo-signing issue that has overtime ballooned into something bigger.

As part of a lawsuit filed by Fannie Mae on Feb. 11 one day after it cut ties with Ben-Ezra & Katz the mortgage giant sought a preliminary injunction to force the law firm to turn over files

on its more than 15,000 cases statewide.

Last week, the Plantation-based Law Offices of David J. Stern notified judges statewide that it was closing its foreclosure business as of March 31, leaving as many as 100,000 cases to be

transferred to new attorneys.

Once these issues have been worked out, and they will be, cases will be back on track in the courts and we will see a 'tsunami' of filings throughout Florida.
