Prosecutors have enormous authority in every phase of a criminal case, from the start of an investigation through the sentencing of a defendant after conviction.
There are a substantial number brought to trial with little or no evidence. There are cases where political careers are made or lost, where television careers are launched, and where a defendants' civil rights are the last thing considered!
Defendants have been beaten and tortured into false confessions, witnesses harassed into making false identifications and statements, the disappearnace of physical evidence; evidence known to be false or misleading and jailhouse snitches to bolster a weak case. There's been overreaching and extrajudiciary comments made to a jury to unfairly prejudice the defendant.
Prosecutors have abused their authority that calls into question the fairness of their conduct. A Constitutional violation can occur without any direct contact with the defendant or her counsel, and it may be a culmination of a series of events rather than the product of a discreet act.
Seldom is a Prosecutor punished for participating in, or creating a government sanctioned conspiracy to convict an innocent person; Judges know it; juries know it; and defendants know it. We are powerless to stop it! It is a disaster wreaking havoc in America!
It seems that Prosecutors have carte blanche while the overburdened defense team has the painfully slow process of unearthing its investigation. State and Federal Bar Association have ethical laws in place, enforcing them is another story.
