When a company finds itself in difficult times they may follow the administration process, Corporate Administration. These days courts grant the majority of Administration Orders in favour of the companies or partnerships seeking this, which due to economic conditions over the last 3 or 4 years has led to a huge increase of this insolvency process. The Government has heralded the assistance of small, medium and large companies, and so for this reason an administration is used to grant the administrator managing the insolvency more time to seek the best solution bespoke for the company they are dealing with.

When reviewing each individual Corporate Administration case, the advisor initially reviews if by undertaking insolvency this method will generate a greater return for creditor than would be the case if the company simply when into liquidation. In almost all cases the primary reason for taking into consideration Administration, is the fact it can be undertaken as a simple pre-packaged sale, which in turn will generate an enhanced return than a sale in liquidation which otherwise would result in the loss of ongoing order book or goodwill arrangements.

An Insolvency Practitioner should identify it if is possible to undertake a CVA, Company Voluntary Arrangement, which will allow the company to continue trading, whilst existing debts are set aside and regular monthly payments are make to placate these old debtors.

They would then investigate whether administration would work for any other reasons, for example, taking into account the current economic conditions and the fact that even the larger long standing high street companies have been forced down this route in order to continue to trade, giving any potential partners the opportunity to increase the value of the business before making an offer. An Insolvency Practitioner should be able to advise you if you do decide to undertake Corporate Administration, if the company you have elected to handle this for you is in fact right for your business.
