subject: The Basis Of A Diflucan Lawsuit [print this page]

Diflucan is an anti-fungal medication from the group of triazoles. It is prescribed to treat and prevent different fungus caused infections like those of the vagina, throat, mouth, esophagus, lungs, other organs and blood. It can also be efficient for patients with a weakened immune system, for those on chemotherapy or before an organ transplant. The medication works by disrupting the formation of fungal cell membrane resulting in the cells death.

The drug is available in pills with 50 mg, 100 mg, 150 mg and 200 mg of active ingredient and in liquid form. It should be taken once a day in dosages and periods prescribed for every patient. Although it is an efficient medication it can also harm certain patients. In 2011 the U.S. Food and Drug Administration issued a warning regarding the risks of congenital malformations in babies whose mothers took high doses of the medication during pregnancy. The reported problems include thin ribs and long bones, bowing of the thigh bones, joint deformation, congenital heart disease, muscle weakness and facial malformations like cleft lip or palate. In case some of these problems occur together they could be the signs of a rare genetic disorder. Because of these problems high doses of Diflucan have been categorized as a Pregnancy Category D Class drug, which means that there is evidence regarding the risks for the human fetus.

Unfortunately before the warning pregnant women were prescribed with high doses of Diflucan and took it for a long period. Some of them gave birth to babies suffering from different malformations. Parents of affected children have the right to file a product liability lawsuit in order to obtain financial compensation. These lawsuits are based on the theory that the drug manufacturing company should have released on the market safe products or at least properly warn patients about the risks involved. If they failed to do so they can be held legally responsible in a Diflucan birth defect lawsuit. As a result of these lawsuits affected families can receive financial compensation to cover the costs of medical treatment and care needed by their child.
