Ediscovery has played an important role in a large number of high profile cases that have involved information being gathered from electronic devices. In recent years there have been many large cases of fraud that have happened and this is an ideal situation where eDiscovery will be used.

What does an eDiscovery company do?

The first stage that this type of company will go through when dealing with a legal case is they take direction from the legal team who are in charge of it. They will have gathered certain resources and subpoenas from judges to access information from specific devices and mediums of communication. At this stage all of the avenues that are going to be used will be managed and identified.

They would then implement certain methods of discovery. If a case is going to be using a lot of data that was sent via a personal or company e-mail then this is going to be their focus for discovery. There may also be a range of computers that have hard drives full of information that is relating to a particular case. The devices are singled out and teams are put to work to extract data from each one.

In instances where a device is damaged data can still be extracted although it will need some specialist skills. This can take a little longer than normal but in a lot of cases it is successful in retrieving important information.

The evidence is then gathered and looked over by the legal team. This is where a discussion will take place and suitable evidence will be used. This is then put into a range of different presentation materials depending on the type of information that is present. The most popular being PDF documents.

In very large cases the ediscovery company will send representatives to present the data in front of a court on behalf of the client and legal firm.

As seen in this example the process of ediscovery is very comprehensive and requires quite a lot of manpower depending on the size of the data that needs to be extracted. A lot of the time legal permission from a judge will need to be sought so that different methods of data extraction can be explored. The role of this type of organisation is extremely important and will start to become more popular and used widely by all ranges of clients in the future.
