Mediation. Is it a guaranteed fix to your problem, or just another waste of time? It's not a waste of time and may be the answer you have been looking for. Right now, in the State of Florida, you are entitled to have foreclosure mediation and the bank is required to pay for it. Mediation is a program where a person trained to be facilitator listens to both sides and tries to help the parties come up with a solution. Foreclosure mediators are trained to know about foreclosure law and the programs available.
The bank or their lawyer may offer you something called conciliation. You do not have to take conciliation in place of mediation. It is not the same thing. A conciliation simply means the bank agrees to talk to you, and let's face it, that already hasn't worked! You may need to ask the court for mediation, or it may be offered to you. In either event, you are entitled to receive mediation. You will need to fill out some paperwork and set a date, but most of this process is pretty straightforward.
Mediation can be your chance to settle a matter that has been hanging over your head before reaching a court ordered final judgment.
