In fact Obamed and his coterie are so intelligent, nuanced, complicated and 'progressive' that we now have Muslim terrorists, responsible for the carnage of 9-11, being tried in a US civil court. Of course that makes perfect sense ! And what do you think the chance is that they will die for their war crimes as they should ? About the same, one could assume, of their chance of getting off under arcane legal procedures, constitutional 'right's and other inchoate legal rules. The Liberal Cultural Marxist fantasy world strides on. Grinning like world class buffoons.
There are a myraid of reasons why Khalik Sheik Mohammed [KSM] and anyone connected with the 9-11 war atrocity, should die. They should be executed when all information, intelligence and anything useful has been extracted, beaten and tortured out of them. Once they become worthless you simply kill them and save your country the time, expense and legal nonsense of keeping them alive. This is the process in a mature, self-confident and rational state.
But not so in Obama's America. No no no. The Great Man of change and hope ! Everything is grey, nuanced, confusingly complex and turgidly relative in Obama-land. Oprah and Dr. Phil and psycho-babble for losers rules the culture. Let's not get hasty with KSM after 8 years of incarceration for one of history's greatest acts of terror. Of course not. The Pakistani stud might be innocent after all. We must review all the evidence, facts, and most importantly his reasons for attacking America. Why, maybe America is the guilty party and not KSM ?
You see America, pace Napolitano, is not officially at war with Islam or Al Qaeda. Muslim war criminals are thus not engaged in a legal conflict, but an illegal conflict, which given the twisted reality of the Obamed's, means that they are civilian murderers, not war criminals. The left-wing cultural Marxists in Obama-land, truly believe that KSM and his ilk are not Islamic-jihadic holy warriors, but mis-informed urban terrorists, unrepresentative of the great cultural force of Islam, who need to have their fair day in court with all due legal procedure and processes lasting for years, including appeals. Maybe after all it is America who is guilty ? Maybe America needs to go on trial ?
There is a good chance that KSM and his friends will eventually be let go. As Ken Klukowski a fellow and senior legal analyst with the American Civil Rights Union wrote for Fox:
If I were KSM's lawyer, I'd argue the following:
1. That his Fourth Amendment rights were violated by letters and conversations that the government intercepted without a search warrant.
2. That his Fifth Amendment rights against self-incrimination were violated if the government attempts to use statements made before he was read his Miranda rights or after he was waterboarded (since the Obama administration calls it torture).
3. That his Sixth Amendment rights were violated by not providing a speedy trial, that the Speedy Trial Act (a federal statute) has also been violated, and that he has been denied adequate legal counsel.
4. I would also say he cannot get a fair trial in New York and move for change of venue.
5. I would challenge the admissibility of any evidence that was unsecured even for an hour, challenge the authenticity of any offered evidence, insist on his Sixth Amendment right to confront every witness against him, including the capturing officers, interrogators, guards, transport personnel, and whoever else I can think of.
6. I would raise objections of circumstantial evidence, hearsay, the witnesses integrity, and every other conceivable objection to the evidence and every procedural step.
It is pretty obvious that the MIMH and the SPIH have not thought this one out. KSM and the Gitmo 5 should be tried in a military court, founded guilty and executed - slowly. More than likely the public won't buy the idea of a civilian court process - especially if anything less than a quick death penalty verdict is passed. The CIA which is the real target of the Obamed's will find a way to fight back massive bureaucracies don't roll over and die because some wonder boy thinks he is a God and has decided that reality does not exist. And the Muslims and their terrorist elements will only view this as yet another sign of sinking US power and faineant weakness. Not exactly the right message in the midst of a long way with a fascist ideology. The MIMH and his friends have just guaranteed more Islamic attacks against the US.
So reality conspires against the MIMH. What remains to be seen is if the American judiciary pushed by the cultural Marxists and the SPIH, will actually let KSM go after a lengthy trial and the inevitable long drawn out propaganda victory for Al Qaeda.
Maybe next the MIMH will put America on trial for causing 9-11 ?
