A tort lawsuit is one way a father falsely accused of sexually abusing his kids or of domestic violence can fight back. You may think it cannot happen to you but the reality is - it can. One of the things you can do to stop the allegations is to fight back with a tort lawsuit. Don't believe when others tell you that you cannot sue your Ex-wife. You can--and should--in this situation.

False Allegations Denied

This is basically what a tort lawsuit allows you to do. Deny the false allegations and other things like defamation of character. You can sue her for these things, as well as for any problems that arose as a result of the allegations, especially where your rights have been violated and loss has occurred. The emotional stress and damage done to you personally as well as to your children can be addressed through a tort.

Fighting Back

When you file a tort lawsuit you are fighting back the legal way. Doing this may not miraculously make the allegations or problems go away but it does say you are not willing to be steamrolled either. When someone falsely accuses another person, that is fraud and misrepresentation of that person. Both are illegal. There is a due process in our courts and the need for evidence when accusing someone.

Getting Serious

Filing a tort lawsuit also lets the Ex and the courts know you are very serious about fighting for your good name. It tells them you are going to appeal and take it as far as you can. Often the mother has been convinced a restraining order is the normal order of business and may not even fully understand the problems it can cause. A tort lawsuit can make her stop and look at her own situation before making yours worse.
