To evict a bad tenant, a landlord has to follow the law of eviction of a tenant. No matter how bad your tenant is, no matter how he/she is the cause of disturbance of the landlord's tenants or no matter how much rent is owed, a landlord can't just do things in his own hands. There are rules to follow in evicting tenants. Actions should always be in a legal way to avoid being sued. The landlord must be precise in giving an eviction notice for him/her not to redo or give notice again and again. Number one is, a landlord must first end the tenancy by giving eviction notice to the tenant. Examples are bellow: Thirty day or sixty day notice This notice can not be given to a tenant until the lease period is over. This kind of notice is given when there is no violation done by the tenant, when just, the landlord has decided to get new tenant. For this kind of notice, the law allows thirty to sixty days but it may be as short as 20 days and as long as 90 days, it depends on the tenants situation. It varies also on the physical condition of the tenant and capability to move out in a given period of time. Unconditional notice This notice is only given when the tenant has seriously violated the rental agreement. Not paying rent on numerous times, having illegal businesses inside the premises, did a major damage in the landlord's property etc. If what is accused to the tenant has been proven, the tenant will have no choice but to move out or be evicted. Nonpayment of rent This is when the tenant didn't pay the rent on rent's due date. The landlord must provide a notice saying that the rent is already in due date, then tenants must be given a three to five days time to pay the remaining balance. Stated there is the agreed date and amount owed to the landlord. And if the requests aren't satisfied by the tenant by the given date, the tenant may leave the premises. Fixing Violations This notice was given to tenants to fix the complaints by the landlord. This is when they've violated the agreed number of people that can live in the property, when junk cars are found in the front yard, when the tenant brought pets that the lease agreement forbids.
