$4,500,000 Jury Award Against Paramedics Who Missed Symptoms Of Placental Abruption

Paramedics, who are usually the first on the scene of a medical emergency must administer treatment that meets the applicable standard of care

. Their ability to notice symptoms, to make quick and correct choices whether to notify a physician for guidance, whether to give medication or treat the person right then and there, and whether to move the patient directly to a hospital, can literally make the difference between life and death. In what follows we look at a lawsuit in which paramedics answered a call from a pregnant woman who had suffered a placental abruption at almost full term of her pregnancy. The paramedics did not recognize the symptoms shown by the woman, including being in shock from blood loss, and failed to take her right away to a hospital. In the delay the unborn baby's oxygen supply was restricted as a result of the placental abruption.

The total of the time it took the paramedics before they decided to transport the expecting mother to the hospital where the infant was delivered was 18 minutes or more. In this time the baby's oxygen supply was substantially restricted due to the bloods loss from the placental abruption.. The infant survived for only one day after being born. The hemorrhaging was so bad that she had to have an additional surgery to control the bleeding. She further suffered from temporary kidney failure due to the loss of blood. The law firm that handled this matter sued the paramedics for their failure to understand the woman's condition and their delay in taking her to the hospital.

States have varying laws in situations involving the death of a baby. In the State where this situation came about, for example, in order to be able to recover for the emotional harm suffered by the mother from the death of her bathrobe for kids the law firm that represented her had to show that the mother (1) suffered a physical injury that came about from the same negligence that caused the death of the infant and (2) that such physical injury to the mother would not have normally happened in a normal childbirth. Within six moths of the death of her newborn's death the mother began suffering from a deep depression.

Despite a treatment program consisting of therapy and medication, the woman was still combating the depression at the time of the law firm's report. She will likely need to stay on medication for life. The mother met those requirements.|All three requisites were present in this matter.|With the injuries the mother herself sustained as a result of the delay by the paramedics, she was able to go forward with a lawsuit.

The law firm that handled the case on her behalf reported that they took the case to trial and achieved a verdict of $4.5 million. Paramedics are health care providers. Paramedics are trained and they are licensed. They are expected to be able to recognize symptoms of emergency health issues and to take appropriate and timely action. Should they not and their actions fall short of the applicable standard of care, they can be liable.
