It happens every day in America. The police (fbi, local cops, state troopers) approach a suspect and start asking him questions. This may occur at a car stop or in a public place. It may even happen in the person's home. What do you do? The thinking most people go through is that if I have nothing to hide, there will not be a problem. Or, If I cooperate with them, they will take it easy on me later. Both of these ways of thinking are clearly wrong.

To begin with the police have zeroed in on you for a reason. The reason may be absolutely false. The main problem is that the police will never tell you why they are speaking to you. They will not answer your questions. The easiest way to handle this is to simply states "Officer with all due respect I want to speak to a lawyer. I am not familiar with criminal procedure." Be respectful, be humble and be firm. The cop is a person and no person likes to be disrespected.After making this statement the officer may say things like "what do you have to hide?" " We just want to clear a few things up." Let us be very clear, under no circumstances are your required to speak with the police. The fifth amendment of the US constitution gives us that right.

If you run into a really angry cop, he will try to threaten you, by saying things like "we just want your side of the story." That is fine, there is a time to tell your story-in front of a jury or judge after you have spoken to your lawyer. I make these recommendations after 10 years as a prosecutor and defense lawyer and watching countless times, how people talk themselves into trouble. The police interrogation is not a fair conversation because it can only get you in trouble. The police hold all the cards. They will not be honest with you, in fact they are legally allowed to lie to you.So, at every opportunity you get make sure everyone hears, "I want a lawyer." If the police want to then lie and say that you did not ask for a lawyer, that is their problem. You have constitutional rights that are very important that you must protect. As soon as possible contact a criminal defense attorney in your are and engage his services. Be respectful, humble and firm.
