Arizonas Partnership Program For Long Term Care

According to Arizona Senior Law, the State of Arizona started its participation in the Long Term Care Partnership program since 1998

. The developed program is a partnership program between the State of Arizona and private Long Term Care insurance companies, providing asset disregard when the policyholder seek eligibility for Medicaid assistance. This program grants residents who wish to apply with incentives when purchasing long term health care policies and is being administered by the Arizona Health Care Cost Containment System or AHCCCS.

These incentives vary from one individual to another which is dependent on the amount of insurance payments the person has collected. And those with more insurance payments benefit more from the program. In return, policyholders can utilize the program more to exclude any type of countable resources.

However, there is one limitation married applicants cannot use the program to exclude resources that are owned solely by their spouse. But, the program still provides qualifying policyholders with significant incentives to invest in long-term care insurance.

Also, the states long term care system does not count some or all of the applicants assets when determining eligibility if the applicant has a long-term care insurance policy that meets certain requirements. In addition to the amount not counted in determining eligibility, AHCCCS will not recover the same amount from the persons estate under the Estate Recovery program.


When it comes to partnership policies, every Policy must comply with Arizona law and must meet the consumer protection requirements consisting of provisions set by the state. In addition, each policy must provide the following inflation protection required (a) If the policy is sold to an individual who has not attained age 61 as of the date of purchase, the policy must provide compound annual inflation protection, (b) If the policy is sold to an individual who has attained age 61 but has not attained age 76 as of such date, the policy must provide some level of inflation protection; and, (c) If the policy is sold to an individual who has attained age 76 as of such date, the policy may provide some level of inflation protection.

Above all these, it is important to remember that (a) the purchase of a Partnership Policy does not automatically qualify you for Medicaid. Medicaid has other eligibility criteria that may disqualify you, (b) asset disregard is only available under a Partnership Policy and not every long term care policy is a Partnership Policy, (c) It is possible that a Partnership Policy will lose its Partnership status in the future if: there is a change to a Partnership Policy, including a change to the inflation protection provisions, the individual moves to a state that does not have a Partnership Program, and there is a change to state or federal law that governs the Partnership Program.

Similar to other states which honour reciprocity, Arizona honours long-term care policies purchased in other states.
