Unemployment insurance is an insurance scheme that was introduced after the great
depression that assisted workers who lost their jobs by no fault of their own. Presently this kind of insurance is financed through tax contributions that employees pay. This insurance assists former employees who have lost their jobs to maintain some amount of financial security.
Typically an employee is eligible for this type of insurance when he or she has worked with the company for a specific period. However there are exceptions to obtaining this benefit which includes the termination of employment by the employee and also the termination of employment due to misconduct. Misconduct is considered any violation of company policies and rules, an inability to conform to certain set standards, and/or consistent carelessness and negligence in the work place. In California the process of acquiring this type of insurance commences with an unemployment claim filed by the employee followed by investigations which includes some form of contact with the employer to confirm employment termination. Once it is approved or disapproved both employer and employee are notified.
However there are channels available to appeal a decision that was not made in the employee's favour. If the employee lives in California then making contact with a California law firm may be vital to the success of any appeal.
