Christmas Shopping Make sure you know you legal rights

Christmas is a time for giving. This is why we all strive to find the perfect gifts for our friends and family.

Finding the perfect gift for a loved one is something we often spend hours agonising over, but despite our best efforts we are not always successful. In fact, a recent survey estimates that the UK public will spend approximately 4bn on presents that are actually unwanted.

Given this rather depressing fact, it is very important that you understand your rights when it comes to shopping just in case you need to enforce them this Christmas

Non-Statutory Rights

Technically speaking if the item you purchase is not in some way faulty, the shop/store you bought it from has every right to refuse to exchange it. Despite this fact many shops/stores, especially the big brand names, do have an exchange policy that you might be able to take advantage of.

A shop's /Store's exchange policy can often be found on their website so if you are unsure of whether to buy a particular gift and there is a chance that you may need to exchange it, make sure you understand a shop's/store's exchange policy before purchasing from them.

If you ask a member of staff whether you can exchange something before you purchase it and they confirm that you would be able to, take their name. Verbal confirmation that exchanges are possible is legally binding.

Statutory Rights

The Misrepresentations Act 1967, Trade Descriptions Act 1968 the Sale & Supply of Goods Act 1994 all provide you with legal protection which may become very useful. Between them these acts ensure that any product you purchase must be fit for purposed, accurately described in any advertising carried out in relation to them and also of a reasonable quality. If you find that any of your purchases turns out to be unsatisfactory and you feel it is the fault of the shop/store you purchased it from, you can always research your rights under these acts and if possible enforce them
