Copyright Infringement of engineering designs causes major losses to Ulka Industries LTD

Ulka Industries to create helpline for companies facing issue of Infringement

Pune: Shri. B. B. Nikam CMD of Ulka Industries Ltd (UIL), pioneers in the manufacture of engineering equipment and machinery of the Cane Sugar industry in India, comes forth to address the issue of patent and copyright violation in the sugar industry.

Infringement has become a major concern and is plaguing and impacting the business at an alarming rate. Its a known fact that Patents and copyrights do not guarantee complete security to ones innovations and products in India. For many years UIL has had to incur heavy loss due to infringement of their products by players in the unorganized sector.

For the last decade UIL has been actively working on educating the system and industry on the legal implications and actions that can be taken against the violation of copyrights and patents. UIL has also started taking strong stance against companies who are violating and infringing on their copyrights and replicating their products in the market.

Take for instance a recent case they are fighting against M/s Jaymahesh Sugar Industries Ltd & M/s BABA Vishwkarma Engineering Equipment Ltd. On 5th October 2012, Mr. Sachin Nikam, duly constituted POA of Shri. B. B. Nikam CMD of UIL filed a complaint with Majalgaon Police Station, alleging infringement of copyright, held by Shri. B. B. Nikam, in an improved sugar cane crushing mill, particularly the underfeed tooth head roller. Mr. Sachin Nikam filed private complaint before the Judicial Magistrate First Class, Majalgaon, wherein on 11th October 2012, the Court found commission of prima facie offence and issued investigation order against M/s. Jaymahesh Sugar Industries Ltd & M/S. BABA Vishwkarma Engineering Equipment Ltd. accordingly, on 13th October 2012, police registered crime vide CR. NO.146/2012 and commenced their investigation. Subsequently, Mr. S. Basavaiah Director of M/S. Jaymahesh Sugar Industries Ltd. filed petition for quashing the complaint before the High Court of Mumbai Bench at Aurangabad.

The High Court dismissed this petition while observing The contents of complaint make out the description of commission of offence complained of. Other points urged by the petitioner are in the nature of defense or bar to the proceedings. There is nothing on facts as brought on record or shown in law to bar further investigation. We are, therefore, not inclined to grant any indulgence. Main prayer for quashing is rejected.

Meanwhile, the police have seized the rollers manufactured by infringing Copyright held by Shri. B. B. Nikam & further investigation is in progress.

Mr. Sachin Nikam, Director of Ulka Industries said, Being in the industry for so long we as company have regularly faced infringement issues. And from our experience want to create helpline for those who are facing such problems. We would also like to create awareness in the system and among the authorities to take action against such crime.
