DUIs Can Reach Law Enforcement Officers
We all know what happens to the average Dick and Jane when they are pulled over on suspicion of driving under the influence of alcohol. The officer will conduct a series of sobriety tests, including a breathalyzer test, and often a host of field sobriety tests, so that he or she can show proof positive that he/she had reason to arrest the individual. Probable cause is important in every state, because without it, the officer has little room for making an arrest. But what happens when the person pulled over is considered a hero in the community, or someone close to law enforcement?
Example 1: Police Officers
Police officers, on or off duty, are not immune to being pulled over if another officer believes that they are driving under the influence. DUI arrests can happen to anyone, and being an upholder of the law does not give you an open door to do what you want to do. You will still need to hire a professional DUI attorney in order to fight the charge, or plead guilty and beg for leniency when necessary.
One such case made the news in late September 2010, with a North Carolina officer getting stopped by one of his fellow officers. It led to his arrest for driving while intoxicated, a charge closely related to DUI in most states. He is on temporary restriction pending the outcome of the investigation, and even his twenty years of experience as a police officer may not keep him from the same punishment that everyone faces for this type of charge.
Example 2: Military Personnel
Even the brave men and women that serve our country and defend it with their lives are not exempt. There are many examples in the news recently of servicemen and women arrested for DUI and similar charges. A charge like this can ruin the career of military personnel, depending on the same factors that can give anyone else problems, known as aggravating circumstances. Some military personnel are tried by the military's judicial system, but they still face the same rules, laws, and penalties as the average person.
Example 3: Firefighters
Firefighters are permitted to break the rules of the road on certain occasions, such as during a fire call. They can run red lights and break the speed limit, although they are still required to take precautions for public safety. Driving under the influence of drugs or alcohol is not one of those liberties that even firefighters are allowed to take, and our heroic firefighters can still be charged with DUI if an officer has reason to arrest them. The punishment is the same, regardless of the status of the person who is found guilty of DUI in the United States.
