Drivers May Not Be The Only Defendants In A Car Accident Lawsuit
When we go into an intersection as a driver or even as a passenger we assume that we will be safe
, given that any controls such as traffic lights, one-way signs, and stop signs, are followed by drivers approaching the intersection. Drivers count on there being a signal , for example, a one-way sign or a no left turn sign, at intersections that allow only one-way traffic from left to right. When an intersection does not have any signs or controls indicating that exclusively one-way traffic is permitted this gives people a false perception of safety.
Take into account for instance what led to a reported vehicle accident lawsuit in which two vehicles crashed as one was going straight and the other was taking a left hand turn. The intersection was positioned close to a neighborhood parish which was having building work carried outin the area. The construction company had taken down not left turn and one way signs that the city had placed to control the intersection. The resulting problem: there were no controls showing that only right turns were allowed at this intersection. By taking a left hand turn the vehicle went the wrong way into a one way street. Therefore by going left the driver went straight onto oncoming traffic.
There was a woman passanger in the vehicle that went the wrong way into the intersection. The accident left her a quadriplegic from a cervical fracture. When the lawsuit was resolved the plaintiff had accrued hundreds of thousands of dollars worth of medical costs |The woman's initial medical expenses were in excess of $400,000 and will need roughly another $4 million for future medical treatment. She was unable to return to work leading to approximately diminished earning capacity of approximately $500,000.
The law firm that handled this claim sued the parish, the construction contractor and the project engineers claiming that they were liable due to the fact they directly or indirectly created the circumstances that gave rise to the accident by removing the signs controlling the accident intersection. The law firm reported that it was able to achieve a settlement with the parish for $500,000 (the maximum amount recoverable from that defendant under the applicable state law), $1,000,000 from the project engineers, and $2 million from the construction contractor . The law firm was thus able to report a total settlement amount of $4.5 million for the victim.
