E-discovery Software Revolutionizes Legal Discovery
E-discovery software can speed up legal discovery in your legal practice
. Suppose you have 20,000 documents which have to be reviewed for an importance case. Boxes of them are stacked in the corner as if a bunker is being built. Mere organization of the files will take a week, to say nothing of reading them all and organizing the findings in a meaningful way.
Enter e-discovery software. Papers are fed through high speed scanners which have the ability to scan front and backs of papers, and legal length documents. All documents are saved in a central server, and then optical character recognition software (OCR) is applied. When documents are originally scanned, they are images to the computer, not text. Sophisticated software reads each image, and recognizes the text, creating documents that can be edited or searched.
The power to search for text in these documents is in and of itself sufficient justification for the process. Suppose you are reading a document and find a critical nugget of information. Is in other documents? What other people mentioned it in memos, reports, personal correspondence. Without computer searchability, you'd have to manually go through thousands of documents to answer this question, but with electronic documents you can search each word of each and every document for any phrases you specify.
This keyword searching is amazing, even though we sometimes take it for granted. Tens of thousands of documents can be instantly searched for a specific counsel, investigating officer, arresting officer, case number. By merely typing keywords, every word in tens of thousands of documents can be searched! People grow tired, miss things. A computer keyword search is infallible and completely thorough.
Or imagine you have a heap of depositions on a large case you've been working on for years. A certain phrasing someone said tickles your brain, but you can't remember who or where. You simply search for that phrase and find every instance of it in thousands of documents.
E-documents can be accessed anywhere. You can't lug all your depositions into a court room, but you are allowed a laptop. During a critical cross examination, you are sure the witness is lying, but can't prove it. You could do research and recall the witness later, but this doesn't make the decisive emotional impact which can swing a jury. You search previous depositions on your laptop, using keywords, and find a previous deposition which disproves what the witness is saying.
E-discovery software has added benefits that include limiting access of less trusted employees to certain documents, simplified workload distribution among researchers, and effortless organization of research findings.
Computers have altered most every profession and workplace, and the law is no exception.
E-discovery software can tip the scales of justice in your favor and help you win that big case. If your opponent doesn't use it, you will have a distinct advantage.
