Austin may be adding another law punishing drinking-before-driving to the books to

help reduce car accidents and clear the roads of unsafe driving.

Drinking While Ability Impaired (DWAI)

The new DWAI law would be applicable to motorists with blood-alcohol content averaging between .05 and .07. The current legal limit for alcohol-affected driving is a .08 blood-alcohol content. The idea behind it is that some people have a lower alcohol tolerance than others. One person may only be able to handle a .05 blood-alcohol level before they start driving dangerously, and currently, there's no alcohol-related law which can punish those offenders. Although many people want to know precisely how many drinks they can have before they run the risk of being arrested, every person's body responds to alcohol differently, making it impossible to set a general limit to the number of drinks a person can consume.

Austin Police Chief Art Acevedo supports the implementation of a DWAI law due to the extremely high number of alcohol-related car accidents occurring constantly across the state of Texas. The Austin American Statesman reports that a penalty has yet to be proposed for DWAI.

Driving Under the Influence (DUI) and Driving While Intoxicated (DWI)

A DUI in the state of Texas only affects drivers under the age of 21. For a DUI, a breathalyzer is unnecessary; as long as the police officer can note a reasonable sign of intoxication, they can issue a DUI to a minor. A DWI, on the other hand, is applicable for everyone else. If you're over the age of 21 and operating any motor vehicle, on land or lake, while at or beyond .08 blood-alcohol content, a police officer may issue you a DWI. For the first offense, a DWI generally results in a Class B Misdemeanor. It's punishable by no more than 180 days in jail and $2,000 in fines. Possible driver's license restrictions may occur.
