Many people have found out the hard way that the information posted on Facebook and other social networking sites can be used against them in divorce court proceedings. In cases throughout the United States, courts have ruled that Facebook postings, status updates, photos and other information can be used as evidence in a litigated divorce and can be presented as evidence against the person who was posting.

This means, for instance, that information you post on your Facebook page may be used to:


Prove fault in a divorce. If your spouse is alleging that you engaged in adultery or an extramarital affair, postings from Facebook showing pictures of you with the person you are cheating with, messages exchanged on the social networking site between you and your cheating partner, or status updates on your Facebook page can all be used to prove the affair.

Prove you are lying about your finances or other issues in the marriage. If you claim that you have no access to marital assets but pictures of you show up on Facebook out shopping or with expensive new purchases, questions can be raised based on these pictures regarding what you are doing with the money available to you.

Demonstrate that you are slandering your spouse. If you are repeatedly posting negative or derogatory comments about your spouse, this can be used as evidence against you. If your spouse is accusing you of parental alienation (turning the kids against him/her), this type of posting on Facebook isn't going to look good for you.

These are just a few examples of how information posted on your Facebook page can be used to hurt you in a litigated divorce. Remember, anything that you post on a social networking site can't really be considered private since you are sharing it with the world.
