The thirty or so lawyers and judges executing worker compensation criminal cases have been warned by the US Chief Justice to stop messing around

. The justice told them that the courts can't be used to abuse public or private rights. The judge spoke from his bench and warned the participants that no further delays will be tolerated. It is not acceptable for the public displays of communication and delay to continue.

No one specific person was accused directly. The conference order was issued after the attorney general blamed some judges for making the state's investigation and prosecution more difficult in alleged workers compensation crimes. Numerous lawyers then commented on those words; they were not pleased with the attorney general making comments outside of court.The chief justice organized the conference in order to get the justice system working faster, and to prevent mistakes during the process.

By putting the worker's compensation courses as top priority, and moving them up on court dockets, the cases may be processed better. Special jury terms were also suggested by the justice to speed the process.As the conference went on, there was one lawyer that alleged that the order wasn't valid, since an order like that needed to be signed by three or more judges. The order from the conference, which put the attending members under a gag rule, was only signed by the chief justice himself.

Comments made out of court in public venues, recriminations and other criticism made specifically to sway public opinion in any manner is not helpful for the justice system.The justice reminded both judges and lawyers of the judicial canons and oaths of office to which they'd both agreed. The lawyers were reminded that issues with other lawyers needed to be dealt with in the proper arena.


That means lawyers could bring up problems with other lawyers in the court itself, with grievance committees or in the legal practice commission. Due process must be given each defendant, the justice reminded the judges, and then stressed that the cases needed to be addressed in a timely manner, as defined by the constitution. The chief justice invited questions from the floor, but clearly stated complaints or excuses about past actions or events were not allowed.

Those issues would be addressed in the correct arena.A clear distinction was illustrated between media reporting and prosecution comments by one attorney whose client had been indicted by a grand jury. The lawyer said our first amendment to the constitution gave the media the right to report, but the Canons of Ethics made public comments by the prosecution inexcusable.


One former administrator's lawyer claimed he had not violated the gag order, but rather had taken the necessary steps to protect his client's rights.One attorney said he would not give up any of his client's rights just to be mean.

One lawyer said that by not saying something, his client may be looked at as guilty Another counselor said that the progression of the publicity given to workers compensation cases was increasing at an unstoppable rate. Finally, one last counsel noted the increasing difficulties that some clients face because of the ever growing influence that negative publicity can have on the judicial process.
