Genuine Private Seller or Curber?

There are generally two ways to buy a car: from a car dealer, who will have a licence to sell multiple cars or from a private seller who is selling a single car, normally their own.

Although it is often cheaper to buy from a private seller, who has no overheads, they have no legal obligations (beyond the car having to be "as described") and will not offer a warranty.

Buyers should also be aware that some unscrupulous dealers may pretend to be private sellers to avoid their legal obligations and, in some cases, off load sub-standard or faulty vehicles. A dealer mascaraing as a private seller is often called a curber', an American term for an unlicensed car dealer who makes a living selling vehicles from the street, or curb.

Be wary of these sellers as they are unregulated as you will have no protection if something goes wrong with the car. The signs of a curber' include:

Only providing a mobile number. While many genuine private sellers might not like to give out their home number, curbers will NEVER provide a home number to avoid being traced.

If they have several ads with the same phone number. Although clever curbers might use a different mobile number per car.

If the seller asks: which one?' when you phone to ask if the car' isfor sale.

If the seller refuses to let you have the car professionally inspected independently.

If the sellers wants to meet in a 'mutual' location, such as a car park. Be wary as they are ensuring you don't know their address in case there are any inevitable problems with the car.

Under the Clean Neighbourhoods and Environment Act 2005' it is illegal to have two or more vehicles for sale parked on a road within 500 metres of each other, unless the seller can prove they are not acting for the purpose of a business. But if there is always a different car for sale along the same stretch it's likely they are being sold by a curber.

Although online traders such as Auto trader work hard to crack down on dishonest dealers, and do not accept private adverts from traders, Trading Standards have to prove that someone is operating as a dealer before they can take legal action.
