How Posting Bail Helps Defendants

When a person commits a serious crime, he or she will be arrested and sent to jail

. Some of the crimes that can land a person in jail are: assault, misdemeanor, driving under the influence, domestic violence, hit and run, and robbery. If a person is arrested for any of these crimes, he or she will be booked in jail and will stay there until their trial. In most cases, trials can take weeks and even months to begin after the initial arrest.

An arrested individual will have the right to bail which can help them be temporarily released from jail. The court judge will set a certain amount of bail which the defendant needs to pay before getting out of prison. The bail process is an agreement that allows the arrestee to be freed from police custody with the condition that he or she will appear at every court trial and proceedings. This requires the defendant to pay for a certain amount of money and to adhere to the agreement. However, there are times when a defendant cannot afford bail. There are times when a court judge sets a certain amount which is too high for the defendant to afford. When such things happens, the defendant can employ the services of a bail bonds agent to help them post bail.

This process involves contacting a bonding agent by the family or friends of the defendant. The bail bonds agent will be the one who will guarantee to the court that the accused will attend all of the court dates and trial dates required. If the defendant fails to show up, the bonding agent will need to pay the full amount of the bail to the court. However, the bonding agent will ask the defendant to pay for 10% of the total bail amount. At certain times, the bonding agent might also ask the family or friend of the defendant to be a co-signer of the bail bond to prevent the defendant from skipping bail. If the defendant does skips bail, the repayment of the bail to the bail bond company who has to pay the court will fall upon the co-signer and they will also be responsible for the cost of finding the defendant.

When an arrested individual posts bail, they will have temporary freedom while awaiting their trial. They can have some normalcy in their lives while awaiting trial.
