Information Technology or IT law with its inherent innovation and globalization represents the fastest growing field of legal issues.

Internet-related law issues include: registration and protection of domain names; developing technology firms and websites; internet commerce; electronic formation of contracts; website content review; liability, jurisdictional and infringement issues; linking; web hosting and development agreementand many other newly developed technologies.

IT lawincludes individual privacy and security, protection of computer software, information access and control, internet law and electronic commerce.

IT law specifically relates to privacy and security since the Canadian Charter of Rights and Freedoms guarantees the right to be secure against unreasonable search and seizure and the disclosure or invasion of a person's private life. The issue of privacy touches on the way technology encroaches upon individual rights and freedoms.

Privacy concerns related to the acquisition or disclosure of information involves informational privacy; privacy may relate to physical seclusion or physical privacy; and privacy may relate to personal decision-making or decisional privacy.

Nine, internationally prominent, privacy experts were asked to define the most important privacy issues confronting people. You can imagine how varied their answers were.

Their answers included: DNA profiling, ID and smart cards, camera surveillance, internet cookies and biometric identifiers (fingerprints and retina reading). But the bigger issue revolved about the concept of re-defining privacy.

An example of how we have re-thought privacy involves social insurance numbers. Before social insurance numbers and computers you were less likely to be involved in fraud or identity theft. With the rapid development of technology, things that we considered violations of privacy in the past, have become commonplace and we will need to rethink them in the near future.


An example of how technology has changed what we say and who we say it to, is social networking sites. A personal linking site with millions of global users, who post photos and personal information, recently changed their policy for developers. Under the old policy, platform developers could only cache user information for less than 24 hours. The limitation has been lifted allowing third-party developers (who create games and other applications for the site) to store user data indefinitely.

That means that developers who don't know you, have access to your personal information since once it's posted on the internet site, it cannot be erased.

Another privacy issue involving IT law is the use of search-engine keywords. Linking a company name with its competitor may not constitute misuse, unless the link infringes on a trademark.

Information technology lawwill continue to address privacy issues and many other disputes as innovation and people interact.
