Inspecting Garbage

I am not a lawyer, I am a judgment referral expert

. This article is my opinion, and is not legal advice, based on my experiences in California. If you ever need legal advice or a strategy to use, please contact a lawyer.

Diving in dumpsters is an old trick used by judgment enforcers to find clues about debtor assets. Some judgment recovery specialists believe it only makes sense to inspect the trash of rich judgment debtors. Yet, many times rich judgment debtors are more careful to conceal, shred, or burn documents, than to toss them out. Sometimes seemingly poor and average debtors throw out the best hints to possible assets.

Diving in dumpsters has risks, and if something goes wrong, do not blame me, because my articles for one's amusement only. For the daring, here are some tips about diving in dumpsters:

A first consideration is - when is your debtor's trash receptacles full, and when are the judgment debtor's trash receptacles collected? After you learn that, make sure that playing with another person's trash is legal in your judgment debtor's jurisdiction. Do not trespass onto someone's private property. Wait until after the garbage receptacles are on the city street. In certain places, folks have to bring their garbage to a transfer location.

One time saver which sometimes used, is to directly contact the garbage vehicle driver or the person driving shotgun with them, and provide them the address of the judgment debtor, and offer them cash to bring you the debtor's trash to you; around the corner, in exchange for payment. How much money depends on several things, $60 to $120 is probably typical.

Using this shortcut, you can conveniently move the debtor's trash to your examination zone. This shortcut is a lot harder in cities having mechanized trash pickup systems. If the garbage employee goes for it, this is the safest way to intercept garbage.

If that time saver will not work, then you have to do it yourself, or pay someone who will. Remember that when the contents of the garbage is getting picked up by any service other than the city - for example, a private trash company, you might be robbing their property. Once garbage is placed in their receptacle, it's their property.

A simpler shortcut, is to figure out what garbage company your debtor uses. Then one can call that company to ask which day they service that street. One could check the situation out on your first pass, then you'll know which color garbage bags they use. On the next garbage date, one could arrive soon, or just before the garbage truck comes along their street.

Recently, lots of places have separate garbage and recycling containers. The great news is often the most important hints will be in the (usually cleaner) recycling bin. The bad news is that two receptacles are usually twice as much of a headache. Also, recycled paperwork is hardly ever in bags, and might need to be picked out by hand.

Although many people use plastic bags to put their trash in, and ties their plastic bags closed, and then places them in the trash receptacle; not all do. If they do not use bags, and only loose and icky garbage in the trash can that isn't inside plastic bags, that is a lot more time consuming, a big hassle, and extra messy.

Judgment Enforcers that have dived in dumpsters, advise that one brings your flashlight. One reason is to separate documents from advertisements and newspapers.

When the judgment debtor trash is bagged, there are 2 ways to proceed; you can replace the judgment debtor's trash bags or not. Some of those that dumpster divers do not replace the bags they take, calculating that most folks would not notice that the trash is missing, and if they do, not as a result of their regular garbage person.

An alternative option used if trash bags are changed, is to remove some other person's garbage (maybe the next block over) who uses the identical color trash bags as the judgment debtor. The trash bags are taken from one garbage can, and used to replace the bags in your debtor's garbage can. That way if the absent bags are noticed, the baffled person will not be your debtor.

If the garbage is inside bags, and you replace the bags, bring at least 6 bags of replacement recycling material. When you don't know what color trash bags the debtor uses, bring both colors. The reason to bring both colors of bags, is to match the color of the bags inside the garbage can. The recycling material can be crushed newspapers (perhaps one of the final uses for newspapers). Your goal is to quickly change your trash for their trash.

A good vehicle to drive when dumpster diving is a pickup truck. After the dive into a dumpster, you could put the tailgate down, and sort the trash on your tail gate. After you are done, you can use a garden hose to clean the back of your truck. Another way to go is to use a floor, with a tarp, drop cloth, or a plastic sheet. Professional divers in dumpsters use a low-cost dust mask, V-Force gloves and goggles. Divers use tongs, and have big spoons and forks handy. When sorting, they place actual garbage into a new trash bag, and the items to save into small plastic bags.

Some divers place a dab of Vicks Vapor Rub cream under their nose, to help reduce the fragrance of the trash. A can of bug spray may be handy. For those who dumpster divers, may your judgment debtor's paper shredders be broken, and may all of your judgment debtors have working garbage disposing machines.
