It Pays To Have Accident At Work Compensation
Employees have compensation laws to assist them when they incur on the job injuries in nearly every country
. Accident at work compensation plans differ from one jurisdiction to another but provision for weekly payments to be paid out in place of wages, along with compensation for the economic loss, both past and future, and medical bill payments and like expenses are considered part of the insurable expenses. Generally, these employee compensation laws are to be found as a feature in more highly developed societies of the industrial type.
Relinquishing employee rights
Some feel the insurance compensation of employees injured on the job is a trade off because they must relinquish certain employee rights, such as the right to sue their employer, if they accept the insurance compensation. This is often referred to as the compensation law or bargain. Often with these types of policies, the employees' right to sue for punitive damages for any employer negligence and pain and suffering must be waived as they are not a part of the workman's compensation plan. This type of insurance is believed to give workers an economic type safety net, even as they remove some employee rights. Unions have long waged struggles to see these compensation plans become a reality.
Compensation put into law
Before the establishment of this form of compensation for workers, the only recourse when injured on the job was to file suit through civil or tort laws if the employer refused to recognize they were at fault. Employees had to prove their employer was negligent in some way or had shown malice toward their workers. This resulted in many law suits being lost and employees not only losing that compensation for medical bills, but they had also lost their job. Employer found it more to their benefit financially to fire that employee rather than pay their medical bills and lost wages.
Once these laws are put into effect, the advantage is seen for both employee and employer as there is now an insurance policy in force to pay for expenses incurred as the result of an accident on the job.
Compulsory Employers Liability Insurance in the UK
There isn't comparable insurance called accident at work compensation available in the United Kingdom currently. Employees must pay for their own private medical plan or expensive health insurance that is privately applied for. Worker safety issues are under the control of the Health and Safety Executive in the UK. This allows the employer and employee to comply with statutory regulations and rules. The employer is required to have Employers Liability in the amount of 5,000,000 pounds at a minimum, per occurrence. The practice is usually to provide, at minimum, 10,000,000 pounds. There is generally an inner limit of 5,000,000 pounds for those who work in high risk categories such as workers on oil rigs.
Before hiring on, employees should make certain the employer has accident at work compensation available for them in case of accidental injury. If not there is a breach of the statutory duty or it may qualify as a tort of negligence so check with the proper laws of the area for verification.
