Personal Work Injury Issues

When the economy is running rather slow, unemployment is high

, jobs are hard to find and keep, people are afraid to report minor injuries that occur in the work place. This is what we are experiencing in the U.S. today.

It is tragic or against the laws that we put in place to try and protect the American work force. But as companies all across the U.S are facing rising costs for everything, some do their very best to intimate their employees, discourage them from filing workers' compensation claims for minor injuries.

Some business will pay out of pocket for your little cut and stitches rather than claim it on their insurance. It is very similar to automobile insurance. You get a good rate and make your monthly payments on time, but as soon as you get a ticket or in an accident, your rates start to go up. Sometimes it takes a couple of years for your rates to go down as long as you do not have any more tickets or accidents.

The Issues And Why They Exist

Some companies just do not like playing by the rules. To do business in the U.S they must carry workers' compensation insurance. If they are caught without the proper insurance they can be fined and even closed down if they do not carry the proper insurance.

The workers' compensation laws clearly state they if a employee incurs an on the job injury and reports the injury to a supervisor Immediately when it happens, the company cannot refuse to claim the injury on their insurance e and take care of your medical cost for the injury.

The problem occurs when the supervisor or person in charge denies that you were hurt at work and you are left with the decision to go to the Doctor and get treated or go back to work so you don't get fired. The hassle it takes for the employee to file a complaint against the company is enormous. You need to hire a lawyer - if you can find one to take the case - and then try or get justice and payment and this might take a bit of time, meanwhile you might not have a job while all this is gong on.

You might very well have a good case and win in the long run however what do you do for the short run? Time and time again people have tried to take these companies to court over these very same issues but to fail in their efforts because of the stress, stain and money involved.

This is an injustice to the American workers and the laws that were designed to protect them but like the saying goes - money talks and without it you are just plain out of luck.

The best thing to do is to try and find a good company to work for and try not to get hurt on the job. Right or wrong - that's the way it is.
