In order to qualify for a QROPS pension transfer, you must first currently be a member of a personal or occupational pension fund. You must also have been or plan to become a non-UK resident for minimum period of five years and should not yet have purchased an annuity. You may not transfer your UK pension into a QROPS if your pension is a basic state pension, if you have already purchased an annuity, or if you intend to remain tax resident in the UK. There are a wide variety of UK pensions that can be transferred into a QROPS including occupational pensions, personal pensions, stakeholder pensions and pensions in draw down.

QROPS are required to apply to HMRC for QROPS status which will only be granted if they meet the standards set by HMRC. As a QROPS fund member, you are only able to draw from the pension once you hit the minimum pension age. The Financial Services Authority has set out guidelines on how such monies can be invested such as in equities and unitised collective investments. QROPS enable pension holders to invest their pensions into a wider variety of investment opportunities including UK invested trusts, listed property trusts, fixed interest investments and managed funds, stocks and shares.

During the first five complete tax years pension holders are only able to take benefits in the same way as they would were they still residing in the UK. After this five year period in which you are required to report to HMRC has elapsed, your access to the fund will depend on the jurisdiction in which the QROPS has been set up, as well as the individual QROPS rules of the QROPS provider. Your eligibility for taxation may also depend on your country of residence as well.
