Misdemeanor offenses are those offenses for which a conviction may result in one year or less of jail time and $1000 or less in fines. Misdemeanors are considered less serious offenses than felonies. The penalty for a misdemeanor conviction can range from very minor. Buying, receiving, possessing, concealing or aiding in the concealment of stolen, embezzled or converted money, goods or property, knowing that it was stolen, embezzled or converted. Michigan defines 4 levels of Receiving and Concealing Stolen Property: $20,000 or more: Felony -- up to 10 years and/or $15,000 fine (or 3x property's value) $1,000 or more but less than $20,000: Felony -- up to 5 years and/or $10,000 fine (or 3x property's value) $200 or more but less than $1,000: Misdemeanor -- up to 1 year and/or $2,000 fine (or 3x property's value) Under $200: Misdemeanor -- up to 93 days and/or $500 fine (or 3x property's value) A prosecutor may charge one higher level of Receiving and Concealing Stolen Property if the defendant was previously convicted of Receiving and Concealing Stolen Property or Attempted Receiving and Concealing Stolen Property. (1) A person shall not buy, receive, possess, conceal, or aid in the concealment of stolen, embezzled, or converted money, goods, or property knowing the money, goods, or property is stolen, embezzled, or converted. 2) If any of the following apply, a person who violates subsection (1) is guilty of a felony punishable by imprisonment for not more than 10 years or a fine of not more than $15,000.00 or 3 times the value of the property purchased, received, possessed, or concealed, whichever is greater, or both imprisonment and a fine: The property purchased, received, possessed, or concealed has a value of $20,000.00 or more. The person violates subsection (3)(a) and has 2 or more prior convictions for committing or attempting to commit an offense under this section. For purposes of this subdivision, however, a prior conviction does not include a conviction for a violation or attempted violation of subsection (4)(b) or (5). Any person appointed by the state treasurer to make the examinations provided for under this act, or any officer, clerk, or other employee of the state treasurer, who receives or solicits any money, gift, emolument, or anything of value for the purpose of being influenced in the matter of the examination of any public account authorized by this act, or for the purpose of being influenced to prevent or delay the examination of any public account, is guilty of a misdemeanor, punishable by a fine of not more than $1,000.00 and not less than $200.00, or imprisonment for not more than 6 months and not less than 30 days, or both. Joshua G. Craft was charged with one count misdemeanor D.U.I. alcohol which was reduced to disorderly conduct for which he received a $500.00 fine and 12 months probation. He was also charged with one count misdemeanor injuring, tearing down or destruction of mailboxes which was reduced to criminal trespass for which he received a $400.00 fine, 12 months probation to be served concurrent and restitution as determined. Frank Gregory Black was charged with one count misdemeanor driving while license suspended or revoked for which he received a $500.00 fine and 12 months probation. He was also charged with one count misdemeanor obstruction of officers for which he received a $200.00 fine and 12 months probation to be served consecutively. He was also charged with two counts theft by taking for which he received a $200.00 fine for each count and 12 months probation for each count to be served consecutively and $189 in restitution.About the Author:
