Religion Disparity

The right to be free from a government-imposed religion and the right to practice

any religion are two freedoms guaranteed by the First Amendment to all Americans.

In the workplace, it is not simply the belief towards a particular religion. It also includes the practices and traditions observed by followers such as the clothing or wearing of traditional garments, hair style or keeping ones hair, eating habits, praying, use of language, and observation of religious holidays.

The law states that employers should not discriminate based on the employees race, color, religion, sex, or national origin. Unequal treatment is unfair for him.

An employer has the power to promote or hire someone. If he uses his power to prioritize others basing on their religion, that is abuse of power.


Even as simple as not allowing the employee to wear a veil or a hat because of his religion can be considered as discrimination. Another type of discrimination is when a co-employee harasses another employee because of his faith.

The employee has an option to adjust to the company he is working for. He can trade shifts or fix his schedule in accordance to both his employer and his religion. But taking the holy month off is not allowed.

Different scenarios of religious discrimination

A group of students form a Bible club. They ask for permission to meet in a classroom before school. While other student-created groups are given meeting space, the Bible club is barred because it is religious.

A Jewish instructor for a county job training program is told that he may not wear his yarmulke while teaching classes.

An apartment complex has a meeting room that is available for residents to reserve for card games, social activities, and similar events. A resident is told that she may not use the room to hold a Bible study with friends.

Three Buddhist monks go out to a restaurant wearing robes, but the proprietor says "we don't allow religious clothes in here. Come back when you are dressed normally."

A town's zoning ordinance requires all houses of worship to obtain a variance in order to locate within its borders. While there are a number of churches already in town, every application for a new house of worship since the ordinance was adopted has been denied.

Another story that came out in the newspaper in New York is about a Sikh-American who sued the New York Police Department for alleged religious discrimination.


Amric Singh Rathour said he was fired for refusing to take off his turban and to trim his beared. He charged three policemen for religious discrimination, negligence, harassment/intimidation, false imprisonment/retaliation and emotional distress.
